Terms & Conditions (Terms of Sale / Use)

1. Introduction
1.1. These Terms & Conditions (the “Terms”) govern your access to and use of the website wbluminare.co.za (the “Website”) and the purchase of any products offered on the Website.
1.2. By placing an order via the Website, you confirm that you accept and agree to be bound by these Terms.
1.3. If you do not agree with any part of these Terms, you must not use the Website or place an order.

2. Definitions

  • “Buyer” / “you” / “your” means the person placing an order via the Website.

  • “Seller” / “we” / “us” / “our” means WBLuminare.

  • “Goods” / “Products” means Hydrate serum (or other skin care products) offered for sale on the Website.

  • “Order” means your purchase request submitted via the Website.

  • “Delivery Address” means the address you specify for delivery of the Goods.

  • “Courier” means The Courier Guy (or any courier used).

  • “Delivery Fee” means the R120 (or other fee) charged for delivery.

3. Formation of Contract
3.1. When you place an Order, you make an offer to purchase the Goods subject to these Terms.
3.2. We may accept or reject your Order (in whole or in part) at our discretion. Acceptance is confirmed when we dispatch the Goods to you (or otherwise notify you of acceptance).
3.3. A binding contract is formed only once we accept your Order.

4. Product Information and Pricing
4.1. We endeavour to display accurate information about the Goods (descriptions, images, ingredients, weight, etc.), but we do not warrant that site content is error-free.
4.2. Prices shown on the Website are in South African Rand (ZAR) and include VAT (if applicable) and any other taxes, unless otherwise stated.
4.3. We reserve the right to change prices, offer discounts, or withdraw offers at any time before acceptance of your Order.

5. Payment
5.1. You must pay in full (including delivery fee) after placing your Order, via the payment methods sent via email.
5.2. If payment fails or is reversed (e.g. chargeback), we may suspend, cancel or withhold delivery of the Goods.

6. Delivery / Shipping
6.1. We charge a fixed delivery fee of R120 (unless stated otherwise) using Courier Guy (or alternative courier).
6.2. We aim to dispatch within 1–3 business days after payment is cleared (unless otherwise stated).
6.3. Delivery times are estimates only; we do not guarantee delivery by a specific date.
6.4. Title and risk in the Goods pass to you upon delivery to the Delivery Address (i.e. once courier confirms delivery).
6.5. You must inspect the Goods on delivery. Any visible damage or defects must be reported to us within 24 hours.

7. Returns, Refunds & Cancellation
Refer to our separate Returns & Refunds Policy.
7.1. You have certain rights under South African law (see e.g. ECTA & CPA) to cancel or return under specific conditions.
7.2. Except where required by law or stated in our Returns Policy, we do not accept returns purely because of a “change of mind.”

8. Warranty & Liability
8.1. The Goods are sold with an implied warranty of quality under the Consumer Protection Act, which means they must be reasonably suitable for their intended use, free of defects, and durable. 
8.2. If the Goods are defective, you may demand a repair, replacement, or refund (as applicable) within six months of delivery. 
8.3. Our liability is limited to the purchase value of the Goods (excluding delivery fees), except in case of gross negligence, willful misconduct, or statutory liability.
8.4. We shall not be liable for indirect or consequential damages (e.g. loss of profits) to the maximum extent permitted by law.

9. Privacy and Personal Data
Your use of the Website and ordering of Goods are also governed by our Privacy Policy.

10. Intellectual Property
10.1. All intellectual property rights in the Website content (text, images, logos, etc.) remain with us (or our licensors).
10.2. You may not copy, reproduce, republish, distribute or commercially exploit any Website content without our prior written consent.

11. Force Majeure
We shall not be liable for any delay or failure to fulfil an obligation under these Terms caused by events beyond our reasonable control (e.g. strikes, natural disasters, courier interruptions).

12. Amendments & Updates
We may revise these Terms from time to time by updating them on the Website. The version posted at the time you place an Order governs that Order.

13. Governing Law & Dispute Resolution
13.1. These Terms are governed by the laws of the Republic of South Africa.
13.2. Any disputes arising shall be submitted to the competent courts of South Africa (or other agreed jurisdiction).
